The Supreme Court strikes again

Obviously this has been a big week for the nine people who currently inhabit the seats of the Supreme Court.   And while the Gay Marriage decision makes HEADLINE news....there are a few other issues that are REALLY IMPORTANT.

THIS ISSUE IS REALLY IMPORTANT FOR GAY PEOPLE

EQUAL RIGHTS FOR HUMAN BEINGS WHO JUST HAPPEN TO BE GAY SHOULD NOT BE THIS BIG OF AN ISSUE

IT'S JUST THE WAY IT SHOULD BE

NOT BEING ABLE TO SUE A PHARMACEUTICAL COMPANY THAT MANUFACTURES A FAULTY GENERIC DRUG
IS AN ISSUE THAT AFFECTS.......

.......EVERYBODY

80% OF THE PRESCRIPTION DRUGS CONSUMED IN THIS COUNTRY ARE GENERIC

THE SUPREME COURT OF THE UNITED STATES RULED THIS WEEK THAT NO ONE CAN SUE FOR MANUFACTURING A FAULTY GENERIC DRUG BECAUSE THE DRUG WAS APPROVED BY THE FDA.

THAT'S A MUCH BIGGER ISSUE BECAUSE IT AFFECTS THE ENTIRE POPULATION

I personally don't know any gay monogamous couples and it's true I don't have many gay friends (there are a few that I wonder about) but almost everybody I know over the age of 10 takes some form of prescription drugs.  EVERYBODY.



And then there is the decision to change parts of the Voting Rights Act of 1965.  This is a very interesting decision that I've had to read three times to fully understand and I'm still not sure what it really means.

I DO KNOW THAT IT'S A CONSERVATIVE VS LIBERAL ISSUE AND REPUBLICAN VS DEMOCRATS AND 7 SOUTHERN STATES AND ALASKA AND ARIZONA VS THE REST OF THE COUNTRY.

I've got to read it again but the fact that Governor Rick Perry of Texas called it a "clear victory for Federalism and the states" and that "Texas may now implement the will of the people without being subjected to outdated and unnecessary oversight and the overreach of Federal power." truly makes me think that this a big victory for full blown assholes.

The Republicans have needed a boost into the arena of civil rights issues since Lincoln went to the theater and by all accounts this is a full step backwards........but of course I'm just reflecting what I'm not sure I'm reading and so if anyone wants to clear this up for me I'd be very appreciative.

AND THEN THERE'S THE CUSTODY RULING.

A three and half year old named "BABY GIRL" by the court was ordered returned to her adoptive parents after living with her biological father for the last year and half.  Known as Veronica, by the rest of the planet, she will be leaving her father and returned to her adoptive parents where she lived for the first two years of her life because the mom, who was not named, gave the baby up for adoption. The father signed the parents, in a text message, for adoption but recanted the next day because he claims he didn't understand what he had signed. He sued and got custody of his daughter then the adoptive parents sued and a year and half later the Supreme Court ruled in favor of the adoptive parents.  The father was claiming because Veronica was "3/256 Cherokee" that he was entitled to keep her according to the Child Welfare Act of 1978 that was created to prevent the breakup of Native American families. 

I suppose before then there were a bunch of Anglo parents trying to own Native American babies......seriously how rampant could that trend have been? 

If the father was being a good father, and apparently he was, then there is no way Veronica should be sent back to her non-biological parents. 

The Supreme Court ruled that "Baby Girl" should be with her adoptive parents BUT the case was sent back to the South Carolina courts who originally had granted custody to the father.

Think of the child's age and how development changes from 2 to 3 and one half.  She might have been bothered when she left at two but at 3 1/2 SHE'S FREAKING OUT.

Regarding the Private Property issue

For those of us in California this ruling will have an impact on Coastal Commission decisions that required landowners to give up some property in exchange for building permits....and that could have something to do with low income housing and public beach access along the coast.

It's going to take awhile to sort out what this means.

MY MAIN POINT OF THIS ARTICLE IS THAT WHEN WE VOTE FOR PRESIDENT OF THE UNITED STATES WE ARE VOTING FOR WHO SITS ON THE SUPREME COURT.  BECAUSE AFTER EVERYTHING IS SAID AND DONE.....THERE ARE NO CHECKS AND BALANCES ON SUPREME COURT DECISIONS....and trust me when I say that the people trying to win a Presidential election know that fact completely.........and while they won't admit it....IT MIGHT BE THE MOST IMPORTANT POWER THAT THE PRESIDENT POSSESSES.

The votes always 5-4

Google or Bing each one and note when they were appointed and the 5-4 vote makes perfect sense.

And just for the record....I've never seen the front page of THE LOS ANGELES TIMES  show pictures of each Justice and how they voted on a particular case.....UNTIL THE GAY MARRAIGE RULING.

Get ready for a sh.t storm on Tuesday

Ever since the Obama's first election......those of us who recognize science as a factual entity....have been waiting for him to have a detailed talk and plan about Climate Change.

This Tuesday, June 25, President Obama will give this long awaited speech at Georgetown University.....and the response will be quite vocal from those who not only oppose anything he says but from those who still don't believe Global Warming is a man made issue.

(CLIMATE CHANGE is the new preferable term to Global Warming)

THERE ARE A WHOLE BUNCH OF THOSE DOUBTERS
AND THIS COMING TUESDAY YOU WILL GET TO HEAR THEM
ATTACK THE PLAN.
 
The plan attackers have double talk experts who will make you think that Obama has no idea what he's talking about and facts and figures will have to be researched and that type of effort will eliminate 90% of the population from learning what is truth and what is exaggeration.

THE NEGATIVE REACTION TO HIS SPEECH WILL BE THE ULTIMATE SPIN SHOW and the general population will gravitate toward the people who say....it's really not a problem....and it's not mankind's fault.

I have no idea what the plan will be but I've been hoping that the President of the United States would take a stand since 1980....

This speech is so far over due that most people have probably forgotten that it's even an issue.

Attempting to curb Carbon Dioxide emissions is a GLOBAL issue and one of things we can't do is not do anything because China and India aren't doing anything.

WE NEED TO SET EXAMPLES FOR THE MERGING MIDDLE CLASS EXPLOSION IN CHINA AND INDIA.

THE FACT THAT PRESIDENT OBAMA WILL STAND UP AND GIVE A SPEECH DEDICATED TO THIS ISSUE IS A HUGE MOMENT.....and long overdue.

I get so frustrated during Presidential elections because the word environment doesn't even get mentioned on the Republican side and Democrats only use it as a catch phrase....and whenever they have a debate, serious environmental questions never get asked.  Just like no one ever asks about Nuclear waste cleanup on our disgraced national  Superfund sites.  That issue is so large and ugly that no one wants to talk about it. I'm even sorry I brought it up. 

I'm really looking forwarding to hearing the plan and  I'm also excited to see how large the anti reaction is.......because sometimes those responses are outright hilarious.

Freaky Twitter account

The Shabab has a Twitter account.

When Twitter first started in 2006 I went on their site to see what the buzz was all about.  I looked at the amount of information they wanted from me and decided I was not going to be a Twittereeerer.  It seemed like they were asking more than the standard sign up information and since I refuse to text, it didn't seem like a platform that would occupy my time.  I did see the potential for other people wanting to voice their opinions in 140 characters or less....but as you've probably noticed by now....it's hard for me to streamline an idea down to a punch line.  I like to surround the situation and then develop an attack plan before I try to make my point.

There are so many times when I wonder if I actually made a valid point, or just traversed the concept without actually arriving at my intented distination.....

I'm pretty sure most of my Mind Jazz readers don't have the slightest idea who The Shabab is. but rest assured they aren't the latest boy band out of Australia.

A few random thoughts

Last week I  picked up an audio book at the library and I'm stunned by how relevant it is......

DIGITAL FORTRESS by Dan Brown...written in 1999....long before Da Vinci Code.

NSA listening is so not new but people letting us know is.....I'm not sure what Mr. Snowden has revealed and will probably have to wait for the movie to find out....but who didn't think this was going on.

The latest interpretation of Superman might be the best.  Just showing how advanced Krypton was is a big advancement in the franchise. 

The San Antonio Spurs are proving that Greg Popovich might be just below the Phil classification.

Subaru makes a cool looking car.

Republicans are trying to take the IRS dealio to the top of the food chain in Washington.  Sometimes it's just as bad when levels just below the top.....think they are doing the right thing.

Am I crazy or do the numbers add up to a vastly improving economy?  Stock market, housing prices, car sales etc.........the unemployment numbers will take longer because manufacturing losses might take ten years to recover.  Learning new skills is not a short term process.

I make more good swings on the golf course than anytime in my life and have been playing golf since the age of 12....that doesn't mean that I play better or score better.  Somethings don't change.

The Great Gatsby was even better the second time.

Aaron Sorkin's NEWSROOM  starts its second season on July 14th,   Might be the best non musical TV show ever made.

The Yasil Puig experience is now in New York and although they got rained out tonight I'm looking forward to the response that a new Mickey Mantle type player gets in the greatest baseball city in the world.  27 championships gives them the bragging rights.

How cool is it that there is a new President in IRAN?  I realize the main man is the Ayatollah but maybe a slight reduction in attitude by the President might move relations in a more civilized direction.
The only leader we get to hear is the President.  The Ayatollah seems to be a rather shy man......externally for sure.

Why can't there be a Pay Per View Rolling Stones concert on HBO or Showtime?

I personally think Kobe will have a great year when he comes back.....but it might not be this next season.  Reach down and pinch your Achilles tendon....now squeeze it.....now snap it.   Imagine being able to play professional basketball within 7 months?

How can people not know who Lindsay Vonn is?  The most decorated skier in American history is a really big deal.

Bees are much too important to be left out of the news.  There should be a weekly national show about CCD.

CANADA DRY GINGER ALE IS ONE OF THE MOST IMPORTANT DRINKS ON THE PLANET.  WHEN YOUR CHILD GETS A STOMACH ACHE AND IT SETTLES DOWN AFTER JUST A FEW SIPS....YOU WILL AGREE WITH ME.  That doesn't change as one becomes an adult.

NSA and CIA and FBI and INFO on you and me

It seems that marketing groups have spent millions and millions of dollars trying to find out every single detail of our lives for as long as I can remember.

The technology upgrade has changed the game plan and for all practical purposes it's going to get even more invasive.

The world of APP's has opened up more windows than one can even imagine.

You download an APP that you think is used for one thing and it's quite possible it's used for something else, along with it's primary purpose.

People can't be naive enough to think that gathering information is going to be limited to what you buy at the grocery store.

In truth....we are involved in a new type of war fare and when there are groups in the world that would like to see the American way of life come to a complete meltdown....it's up to someone to make sure that doesn't happen.

It's actually your job and my job....but we are too busy being Americans and enjoying this treasured way of life to start spying on every asshole and dickhead that wants to cause THE CURRENT UNITED STATES SYSTEM to fail......so......

SOME ONE'S GOT TO DO IT!

If in that process of trying to fend off any form of attack....some useless information gets recorded ......than so what?

THE QUANTUM COMPUTER SYSTEMS THAT ARE IN OUR IMMEDIATE FUTURE WILL DO IT....WITH OR WITHOUT OUR HELP.

I'm hoping that the intrusive technology (IT) makes it extremely hard for fanatical groups to conduct their destructive behavior within our borders.  Actually I'd like to see IT being extended to every country on this planet.

I'd like to know that it's impossible for anyone who wants to blow up people who don't agree with how GOD should be loved....to succeed.

I'd like FAILURE to be the optimum word when discussing terrorists activity AND IF we have dormant dickhead cells operating within our borders then someone needs to be doing the dirty work..

Your taxes pay the salaries of every three letter government organization.  I'd even like to think that there are some two letter organizations and maybe even one letter organizations that are doing everything possible to keep America safe.

If someone is listening to my phone conversations and reading my e-mails and trying to decipher my blog then all I have to say.....HEY.....BUY SOME OF MY ARTWORK!

Party rules and expectations

As the summer rolls into high gear there are millions of people in this country who will attend a party or two or three or four or....... Hopefully if you live near an ocean your party will be at a beach house.

There are certain areas on both coastlines that offer high end entertainment possibilities due to the cost of the property involved.   Some of this property is available to rent for a month or two during the summer for prices that would be hard to imagine for most Americans.

Imagine $100,000 a month for a house on the beach in Malibu.......now stop imagining because it's true, even though most high end rentals are in the $70,000 a month range. 

I think the next door renting neighbor, of my friends in Malibu, is paying $500,000 because he is so uptight the money squeeze is making his brain very very very small.

 

When someone tells you to stop the music and dancing at 11:30 on a Saturday night party, which is being attended by only 10 people, and then mentions that the same house just had a party last week (Memorial Day) and that this party nonsense has to stop.....then it means that the person renting the house, on the beach, during the summer, in Malibu, simply chose the wrong location for seclusion.

I agreed there are certain party rules that should apply where close proximity neighbors are involved.

#1 Invite the neighbors to the party when it's going to be attended by more than 50 people.
     (it's very easy to have a party with 25 close friends and family and the uptight neighbor has no business attending that type of private function.

#1a  Rule 1 doesn't ever actually take place unless the neighbors are hot.  If they are really hot they are probably having their own parties that you want to attend.

#2 During the week there should be a 10 o'clock curfew on outside music.

#3 On Friday and Saturday 12 o'clock should be the curfew for outside music.  There should be no curfew on anything going on inside the house.  Common courtesy would dictate that windows facing the houses on either side should be closed during any party that goes beyond 12 pm.

#4 Special Holiday's like Memorial Day, 4th of July and Labor Day are exempt from all rules.
    #4a  Birthday celebrations are also exempt from all rules.          

#5 No Rap music should be allowed at any party on the beach.  Rap music is only allowed at inner city parties east of the 405.

#6 All beach parties must have multiple FlashFlight LED disks made by

#7 All neighbors that complain about music on Saturday nights before 12 pm should have to cook breakfast for the people having the party.

#8 Cats should not be allowed at beach parties.

#9 Drones should not be used to eliminate uptight neighbors even if you work for Boeing and have access to their weapons program.

 #10 Smoking tobacco will never take the place of smoking pot so why smoke the bad when you can smoke the good stuff.  And remember it only takes one hit.

The idea of having a party is to celebrate someone or something or not. 

THERE ARE NO REASONS NOT TO HAVE A PARTY.....ESPECIALLY DURING THE SUMMER ON THE BEACH IN MALIBU.

It would be so cool to have all of 55's (address) neighbors have a party on the same night and simply not invite him.

Or God forbid......everyone near him just decides that he is right
and no more parties
no more fun.

but then again.......

There are common sense rules that apply to how parties should be constructed but no where on earth does a party on Saturday night have to end before 12PM.

End of story.

Beach access along PCH in Malibu

I realize that nonpretty soon Larry Ellison and David Geffen will own most of the property between Duke's and the Malibu Pier....but this is a list you need to keep in your wallet when visiting Malibu.

You might have to search around for the entrance and there might be signs that say Keep Out and Private Property but they are just trying to keep you from the sand.
